From Beginning to End: The Supreme Court of the United States

If we analyze the purpose for the creation of the judicial
branch of our nation’s government, it was the epitome of perfection because of
its simplicity. According to the definition in the Constitution, signed by our
Founding Fathers in 1789. The Court was given one responsibility, one purpose.
Unlike the executive and legislative branches, it was not designed to create
laws, or alter their meaning. The only purpose of the Supreme Court is to make
decisions whether or not laws created by federal, state, and local governments,
and rules and regulations conform to the Law of the Land; the Constitution of
the United States of America.
The most serious problem faced during the Constitutional
Convention was how to ensure that the only purpose of the Supreme Court would not be influenced by outside sources,
most significantly politics.
After days of lengthy discussions our Founding Fathers
decided that if the justices of the Supreme Court were not included in the
process of elections, they would be less likely to succumb to interference from
individuals and organizations attempting to force their own opinions into the
outcome. Their overestimation of humanity, resulted in one of the biggest
mistakes in our nation’s history.
The men who created our nation believed that if justices of
the Supreme Court were given lifetime appointments, the possibility of
political involvement would be unlikely.
THERE HAS ALWAYS BEEN SOME INFLUENCE FROM SPECIAL INTERESTS
More than two centuries later, the amount of influence from
both political parties has become excessive. Because the presidents who
nominate justices come from one of only two political parties, Supreme Court
nominees are chosen based on their personal, political beliefs.
Over the last four decades, political biases has become the
only justification for nominating justices. Perfect examples include Clarence
Thomas, Samuel Alito, and the three forced upon us by Trump and Moscow Mitch
McConnell: Neil Gorsuch, Brett Kavanaugh, and Amy Coney Barrett.
Politics has become the only factor since 2020 when the last
of Trump’s appointees, Amy Coney Barrett became a justice although Moscow Mitch
violated his own rule of not appointing a justice during an election year. The
hidden truth is that the last three had only one qualification: they promised
to overturn Roe v Wade.
They owe their lifetime appointments to the Republican Party
and the Federalist Society. If they so choose, they will live the remainder of
their lives, 30-50 years, as Supreme Court Justices. Only the impeachment
process can remove them, regardless of the damage they will do to our nation’s
future.
A NEW AND UNCONSTITUTIONAL COURT
This biased Court, with a majority of 6-3, is exceeding its
purpose. It is writing and rewriting laws based on the demand of right-wing
extremists.
They are violating the intent of the Constitution, and
grabbing powers they were never intended to possess.
OUR FOUNDING FATHERS ACKNOWLEDGED THEIR MISTAKES
Many of our Founding Fathers acknowledged some of the
mistakes made in 1789. They expected their successors to improve upon their
efforts.
However, since the end of the Constitutional Convention,
only one serious change was made.
The 22nd Amendment was signed into law on February
27, 1951 A President of the United States was limited to two terms or a total
of 10 years. This was a reaction by Republicans to the successes of one
unbeatable President. Franklin Delano Roosevelt served as our nation’s
President from 1933 until his death in 1945.
Unfortunately, the legislative and judicial branches are not
restricted in a similar manner.
Today, two of our branches of the federal government have
accumulated great power, and with great power comes corruption.
I have no suggestions and no hope that this terminal problem
can be repaired. There are no possibilities for change because change would
require action by the legislative branch.
Power corrupts, and absolute power corrupts absolutely.
