Biden Begins a Path for Change with Plans to Repair a Broken Supreme Court

If our Founding Fathers were alive today, they would take a long look at what they accomplished in 1789. Much of what was done during the Constitutional Convention was both great and revolutionary. However, they would also learn that they overestimated their faith in mankind, and this single fact placed the future of the new country in jeopardy.

At the top of their revelations would be the failure to establish term limits for all three branches of government, and their creation of the Electoral College. Their intent was to allow the people to choose their president, but the Electoral College gave that right to the states. They believed that every vote should count, but that has never happened.

“Power corrupts and absolute power corrupts absolutely.” This quote describes both the legislative branch and the judicial branch in the 21st century.

The legislative branch is not broken, it is shattered and dysfunctional. Lost are the precepts of a two-party system when deliberation and compromise resulted in laws which were beneficial for the majority. Not only do Democrats and Republicans fail to work across the aisle, members of the former Grand Old Party are divided into groups which represent moderates, progressives, extremists, and fascists.

Without term limits, the same problems which exists today will continue for many years to come.

WHY DID OUR FOUNDING FATHERS GIVE LIFETIME APPOINTMENTS TO SUPREME COURT JUSTICES?

Between 1787-1789, the men who met in Philadelphia knew that the executive and judicial branches would face political battles over ideology, and protecting the rights of the many over the ambitions of the few. To prevent the judicial branch, the Supreme Court, from being politicized, they removed the necessity for elections and gave them lifetime appointments. Their naivete about mankind’s ambitions for power and wealth created what we have today: a Supreme Court which is making laws, not interpreting their relationship to the Constitution. Six right-wing extremist justices have recreated their purpose. They are repealing decisions by legitimate Courts in the past and creating laws in support of fascists on the right.

PRESIDENT BIDEN MAKES HISTORY

In 2001, Supreme Court President, George W. Bush, invaded Afghanistan. He claimed that he would kill or capture the architect of 9/11. However, he failed, but decided to leave military forces in a sovereign nation.

History tells us that no foreign nation has succeeded in their ambitions to conquer and control Afghanistan. The most recent effort prior to America’s invasion occurred between 1979 and 1989 when the Russian military waged war in Afghanistan, intending to take control of the entire country. However, ten years later a crippled and embarrassed Russian military retreated and abandoned its efforts.

In a somewhat controversial decision, President Biden decided that our nation’s military could not win the war and removed the last of our forces in August of 2021, ending America’s longest war, and its third major defeat. Regardless of how history views this decision, I believe it was the right thing to do. No one before him had the courage to do the right thing for our military and the country.

Today, July 16, 2024, the White House is proposing a major change for the highest Court in the land.

[President Biden is finalizing plans to endorse major changes to the Supreme Court in the coming weeks, including proposals for legislation to establish term limits for the justices and an enforceable ethics code, according to two people briefed on the plans.]

It's way past time for this change. Limits for the legislative branch must follow.

No president since John Kennedy had the courage to face our Founding Fathers mistakes. If Mr. Biden can effect these changes, he will be remembered as one of the few “great” presidents in American history.
